The Commercial Court in Split opened proceedings on 29 September. Two competing insolvency applications had been withdrawn. Domagoj Poljak was appointed administrator on 2 October—but successful restructuring is not yet assured.

01

The application has become an opened proceeding

The Commercial Court in Split opened pre-insolvency proceedings over Studenac d.o.o. on 29 September 2026 in decision St-431/2026-20. The story is therefore no longer only about an application, but about formally opened proceedings.

Croatia's predstečaj procedure provides a framework for reorganising obligations before possible insolvency. Opening it does not mean restructuring has already succeeded, nor does it mean every shop will close.

02

The other two applications were withdrawn

A&G LOGISTIKA 01 withdrew the insolvency applications registered as St-432/2026 and St-433/2026. The court discontinued both cases on 29 September, so they no longer prevented the pre-insolvency proceeding from being opened.

The earlier account of three parallel files was accurate on 26 September but became outdated. Withdrawal does not by itself prove that all debts were paid or that agreement was reached with every creditor.

03

Why the court opened proceedings

Studenac relied on imminent inability to pay. The court requested additional documents and later said the requested material had been submitted.

A FINA certificate dated 24 September showed one day of continuous account blockage, which the court treated as grounds for pre-insolvency. This is dated procedural evidence, not a live account status on 4 October.

04

A new administrator since 2 October

The court initially appointed Nikola Božiković. At his request it relieved him on 2 October and appointed Domagoj Poljak instead. Božiković said he had advised creditor DREAMLAND in collecting a claim against Studenac.

The court considered that earlier connection sufficient reason for a change to ensure independent and impartial conduct. The decision does not allege a criminal offence. Handover was ordered within three days.

05

What creditors must do next

Creditors must file claims with FINA on the prescribed form within 21 days of service of the decision. The period does not begin when somebody reads an online news report.

The claims examination hearing is scheduled for 10 February 2027 at 9:30 am at the Commercial Court in Split. Deadlines can change, so affected businesses should monitor the file and their own legal duties; this article is not legal advice.

06

What customers can—and cannot—infer

The court decisions govern the proceeding, not the opening hours of every shop. They prove neither a chain-wide closure nor a guarantee of stock, jobs or every future delivery.

The implications are broader for employees, landlords and suppliers than for shoppers. Opening proceedings creates a framework, but does not confirm a viable plan or the required approvals. Later court documents will matter.

07

Which earlier report this article replaces

The article was first published on 26 September and fully updated on 4 October. The application stage remains part of the chronology but is no longer the current headline. The new status is based directly on the decisions of 29 September and 2 October.

We do not call the process final or legally conclusive: both decisions contain appeal instructions. Nor do we claim the outcome is settled. The public court file remains authoritative.
